Am I required to add attorney representation?

It depends on your state. Some states, like Alabama, West Virginia, and South Carolina, require attorney involvement, while others, such as California, only require it specifically if addressing spousal support. New York only requires attorneys if you add in embryo disposition clauses.

They are independent attorneys, so all of their calendars may differ. You must book your representation call after your prenup has been generated so the attorney may review your document before meeting.

When do I start Representation?

You can purchase representation at any stage in the prenup process. However, scheduling an attorney meeting and conducting the representation session should happen after your prenup draft has been generated in the HelloPrenup platform. This allows the attorney to review the document before meeting with you.

You can pay for representation at any point during the prenup process. However, it’s best to make the payment once your prenup draft has been generated. After payment, you can schedule a meeting with an attorney to discuss the document, allowing them to review, suggest modifications if necessary, and sign the agreement.

Can one attorney represent both of us if we agree on everything?

No, unfortunately not. One attorney cannot represent both fiancés because it creates a conflict of interest.

Will the attorney review my prenup before my representation appointment?

Yes! If you purchase attorney representation, your attorney will review your generated prenup before your 1-hour consultation. During your consultation, you can discuss any questions you may have about the agreement and any desired customizations.

If my representation attorney needs to communicate with my fiancé’s representation attorney, will this increase the cost?

No, it will not! The attorney representation fee is a flat-fee, not an hourly rate. It includes three rounds of document revisions and communications with opposing counsel as necessary.

How much time does the attorney have to finish the revisions?

The average turnaround time is 3 business days. The typical range is between 1 and 7 business days. This timeframe can vary based on the level of requested edits that either fiancé may have for their respective attorneys.

If I hire representation, does my fiancé have to hire representation as well?

Not necessarily! Assuming you reside in a state that does not require attorney representation for both fiancés, one fiancé can hire an attorney and the other can decide to waive attorney representation.
